Welcome to Detected. These Terms of Service ("Terms") govern your access to and use of the Detected mobile application ("App"), website at detected.com ("Website"), and all related services (collectively, the "Service") provided by Webair AI LLC ("Company," "we," "us," or "our").

By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have the consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet these requirements.

2. Account Registration

To access certain features, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

3. Description of Service

Detected is a personal security application that provides the following features:

  • SOS Emergency Alert: A one-tap button that triggers an audible alarm, visual alerts (flashing lights), and sends notifications to your designated emergency contacts.
  • Safety Walk: A timed check-in feature that allows you to share your status with a trusted guardian during walks or other activities.
  • Room Scanner: A tool that scans for nearby Wi-Fi and Bluetooth signals and guides you through physical checks to help identify potentially hidden devices in hotel rooms, Airbnbs, or other accommodations.
  • Dark Web & Exposure Monitoring: A feature that checks whether your email address has appeared in known data breaches or dark web databases, with optional active removal services.

4. Important Disclaimers About the Service

Detected is not a substitute for emergency services. If you are in immediate danger, call 911 or your local emergency number. The SOS feature is designed as a supplemental safety tool and does not guarantee contact with or response from emergency services.

The Room Scanner feature provides clues and indicators, not definitive proof. It detects nearby wireless signals and guides you through physical inspections. Results should be interpreted with appropriate judgment.

Dark web monitoring relies on third-party databases and APIs. We cannot guarantee detection of every breach or exposure event.

5. Subscriptions and Payments

Detected offers both free and paid subscription tiers. Paid subscriptions are billed through Apple's App Store ("Payment Processor"). By purchasing a subscription, you agree to the pricing and payment terms presented to you at the time of purchase.

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • You can manage and cancel subscriptions through your Apple ID account settings.
  • Refunds are handled in accordance with Apple's refund policies.
  • We reserve the right to change subscription pricing with reasonable notice.

6. Free Trial

We may offer free trial periods for paid features. If you do not cancel before the trial ends, you will be automatically charged for the applicable subscription. Trial eligibility is determined by Apple and may be limited to one trial per Apple ID.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or to violate any applicable laws or regulations.
  • Misuse the SOS feature to make false emergency reports or harass any person.
  • Attempt to reverse-engineer, decompile, or disassemble the App.
  • Interfere with or disrupt the Service or servers connected to the Service.
  • Use the Service to collect personal information about others without their consent.
  • Use the Room Scanner to engage in surveillance or any activity that violates another person's privacy rights.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.

8. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, images, audio, software, and the underlying code — are the exclusive property of Webair AI LLC and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our prior written consent.

9. User Content

You retain ownership of any content you provide through the Service (such as emergency contact information and account details). By providing content, you grant us a limited, non-exclusive license to use, store, and process that content solely for the purpose of providing and improving the Service.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the practices described in the Privacy Policy.

11. Third-Party Services

The Service may integrate with or rely on third-party services, including but not limited to:

  • Apple App Store (for distribution and payments)
  • Firebase (for authentication and data storage)
  • Have I Been Pwned API (for breach monitoring)

We are not responsible for the availability, accuracy, or practices of third-party services. Your use of such services is subject to their respective terms and policies.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WEBAIR AI LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.

THE SERVICE IS PROVIDED FOR PERSONAL SAFETY ASSISTANCE AND IS NOT A GUARANTEE OF SAFETY OR SECURITY. WE DO NOT WARRANT THAT THE SERVICE WILL PREVENT HARM, DETECT ALL THREATS, OR FUNCTION WITHOUT INTERRUPTION OR ERROR.

13. Indemnification

You agree to indemnify, defend, and hold harmless Webair AI LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another party.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

15. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination (including, without limitation, liability limitations, indemnification, and dispute resolution) will survive.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by other appropriate means. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

17. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in New York, New York. You agree to waive any right to a jury trial or to participate in a class action.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Webair AI LLC regarding the Service and supersede all prior agreements and understandings.
